Abstract:The effective regulation of disciplinary power is helpful to maintain the order of teaching and protect the students’ right. Because the civil law and criminal law can not effectively regulate the disciplinary rights,so it is necessary to regulate by administrative law, which is more in line with the character of disciplinary power. However, there are still many defects in the process of regulating the disciplinary power in administrative law. In order to construct the system of appeal and administrative appeal in school,the establishment of disciplinary power should strictly follow the principle of legal reservation, the provisions should not violate the upper law, the implementation should conform to the principle of due process and proportion.In addition, it is also necessary to construct the complaint mechanism.
