Abstract:The legalization of the establishment of agencies in state-level new areas is the basic guarantee for the building of the law-based government.At present,there are three types of agencies in state-level new areas:government,administrative committee,and the combination of government and administrative committee.The management committee is easy to produce the non-standard phenomenon such as randomization and administration in the process of establish the organization, so it is urgent to solve the above problems through the legal path.The problems involved in the legalization of the establishment of the state-level new district institutions mainly revolve around whether the organizational orientation of the new district management committee is clear, whether the legal standard supply of the new district institutions is sufficient, and whether the legal density of the new district institutions is appropriate or not .In order to realize the scientific, standard and legalization of the establishment of agencies in state-level new areas,it is necessary to make it clear that the administrative committee should be regarded as the government agency, establish the standard of establishment of agencies in state-level new areas oriented by administrative task,reform the procedural elements of the establishment of agencies,accurately divide the types of administrative agencies in state-level new areas,and digitalize the norms for the establishment of agencies.
